By accessing or using Heartbeat ("the Service") at heartbeatvisuals.com, you agree to be bound by these Terms of Service. Please read them carefully.

1. Use of the Service

Heartbeat provides a browser-based tool for creating animated data visualizations. You may use the Service for personal or commercial purposes, including creating content for monetized social media accounts.

You agree not to:

• Use the Service for any unlawful purpose
• Attempt to reverse engineer, copy, or redistribute the Service
• Use automated means to access the Service in ways that could damage or overload our systems

2. Accounts and Subscriptions

You must create an account to use Heartbeat. You are responsible for maintaining the security of your account and password.

The Service is offered with a 7-day free trial followed by a monthly subscription of $10/month. You may cancel at any time. Cancellation takes effect at the end of the current billing period — no refunds are issued for partial months.

3. Your Content

Charts, videos, and data visualizations you create with Heartbeat are yours. We claim no ownership over content you produce using the Service.

Your uploaded data (Excel, CSV files) is processed locally in your browser and is not stored on our servers.

4. Third-Party Data Sources

Heartbeat integrates with third-party data providers including FRED, Alpha Vantage, World Bank, CoinGecko, Our World in Data, ESPN, MLB (statsapi.mlb.com), and NBA (stats.nba.com). Use of data from these sources is subject to their respective terms and licensing agreements. This data is provided for personal and informational use; you are responsible for ensuring your use of third-party data — including any commercial redistribution — complies with the applicable provider's terms.

5. Availability

We aim to keep Heartbeat available at all times but do not guarantee uninterrupted access. We may update, modify, or discontinue features of the Service at any time.

6. Limitation of Liability

Heartbeat is provided "as is" without warranties of any kind. To the fullest extent permitted by law, we are not liable for any indirect, incidental, or consequential damages arising from your use of the Service.

7. Changes to These Terms

We may update these Terms from time to time. Continued use of the Service after changes are posted constitutes acceptance of the updated Terms.
